The contract is concluded for a firm duration of four (4) years.

The contract's start date is the date of its notification, which is when the successful tenderer receives the commitment act signed by both parties.

Key milestones and phases include:

• Prestation n°1: Initialisation, which involves the Contractor understanding the context, familiarizing with processes, framing work with identified stakeholders, drafting deliverables, establishing an inventory of existing documentation, and setting up necessary resources and tools.
• Phase de transférabilité/réversibilité de la TMA, where the outgoing Contractor ensures a complete knowledge transfer to the takeover team. This phase includes a launch review meeting at the beginning, a presentation of the application third-party maintenance organization (minimum 1 working day) during the phase, and a closing meeting at the end.
• A launch meeting (réunion de lancement) is defined as milestone T1 in the project calendar.
• Deliverables have deadlines relative to T1, such as "T1-3 working days" for the launch meeting support, "T1+15 working days" for the definitive management and quality assurance plan, and 5 working days after the session for the meeting minutes.
• For certain deliverables like the impact analysis report, action plan, and technical documentation, the deadline is "at the end of the contractual period".
• The execution period for purchase orders can extend up to 6 months beyond the framework agreement's validity, with individual purchase order execution durations ranging from 1 to 12 months.
• A minimum guarantee of twelve (12) months applies to the services, starting from the notification date of the admission decision for prestation 1.

The core scope of work for this tender involves services related to the third-party application maintenance (TMA) of the "SI Contentieux" system and its associated software licenses, specifically the Legisway solution.

The key services (prestations) and their summaries are:

• Prestation n°1: Initialisation - This includes a launch meeting to present the context, team members, roles, responsibilities, documentation status, work procedures, project schedule, expected results, and initial management, quality assurance, and security plans.
• Prestation n°2: Maintenance préventive, adaptative, corrective et Maintien en Condition de Sécurité (MCS) - The contractor is responsible for ensuring continuous access to the "SI Contentieux" and maintaining the Legisway software licenses. This covers preventive, adaptive, and corrective maintenance, as well as maintaining the system in secure conditions.
• Prestation n°3: Licences - This service aims to renew the necessary liberatory licenses to ensure service continuity for users accessing "SI Contentieux".
• Prestation n°4: Etude et Analyse impact - This involves conducting studies and impact analyses.
• Prestation n°5: Mise en œuvre d'une évolution - This service covers the implementation of evolutions or changes.
• Prestation n°6: Formation des utilisateurs - User training is a key component, including sessions for users, administration referents, and functional administration, which can be delivered on-site or remotely.
• Prestation n°7: Réversibilité/transférabilité - This service focuses on reversibility and transferability aspects of the TMA.
• Prestation n°8: Passage en C1DR - This refers to the transition to C1DR.

Key deliverables include:

• Support for the launch meeting, definitive management and quality assurance plans, definitive security assurance plans, and meeting minutes.
• Corrective patches or new minor versions of application components, functional specifications, technical architecture files, user and functional administration manuals, and updated technical incident tracking.
• Security patches or new versions of application components, updated user and functional administration manuals, updated security operating procedures, updated system security policies, updated security maintenance plans, and updated SSI action plans.
• Regularly updated management and quality assurance plans, risk analysis files, maintenance activity dashboards, operational progress monitoring files (including activities, key facts, upcoming activities, action tracking, traceability matrix, deliverable production progress, and financial tracking), and configuration monitoring files.
