TENDER DESCRIPTION

1.1. The procedure is conducted in the form of an open tender on the basis of Article 129(1)(1) and (2) in conjunction with Article 132 and subsequent provisions of the Public Procurement Law (Ustawa Pzp), with a value equal to or exceeding the EU thresholds. 1.2. The Contracting Authority provides for application of the inverted procedure in accordance with Article 139(1) of the Public Procurement Law (Ustawa Pzp), which means that it will first examine and assess the tenders and then perform the entity-based qualification of the contractor whose tender has been rated highest, in terms of the absence of grounds for exclusion and fulfilment of the conditions for participation in the procedure. Therefore, the Contracting Authority provides for the possibility of requesting the declaration referred to in Article 125(1) of the Public Procurement Law (Ustawa Pzp), i.e. the JEDZ, exclusively from the contractor whose tender has been rated highest, which also means that contractors are not required to submit these declarations together with the tender. 1.3.
