TENDER DESCRIPTION

1. Under this contract, the provision of the service in the period from 1 January 2027 to 31 December 2028 that meets the requirements described in the Draft Contract is guaranteed. 2. The service in the period from 1 January 2029 to 31 December 2030 that meets the requirements described in the Draft Contract will be provided under the “option” right referred to in Article 441 of the Public Procurement Law (PZP). In connection with the above, the Contracting Authority: 1) reserves that the subject matter of the contract specified under the option right is not guaranteed and is the Contracting Authority’s exclusive and unilateral entitlement; failure to exercise this entitlement shall not constitute a basis for the Contractor to pursue any claims against the Contracting Authority; 2) is entitled to exercise the option right within a period of up to 12 months from the date of conclusion of the contract; 3) if the option right is exercised, will provide the Contractor with a relevant declaration to that effect; 4) other provisions regarding the option right are set out in the Draft Contract constituting Appendix No 1 to the SWZ. 3.
