TENDER DESCRIPTION

For the active ingredient Adalimumab (ATC code: L04AB04), AOK Niedersachsen offers non-exclusive rebate agreements. For the period until the entry into force of exclusive agreements as a result of a formal procurement procedure in accordance with the rules of Part 4 of the GWB, AOK Niedersachsen offers all interested pharmaceutical companies, without a selection decision, rebate agreements. Contracting is carried out within the framework of an “open-house model” and serves as a bridge between the start of generic competition (expiry of the patent) and the award of exclusive rebate agreements. The agreements offered are non-exclusive; agreements with all market participants (pharmaceutical companies) are desired by AOK Niedersachsen. Under the open-house model, uniform conditions apply to all participants. Contract content, terms and conditions, and access procedures are uniform—individual negotiations are generally not conducted. The agreement terms are a maximum of twenty-four months; the earliest possible start date is 01.11.2026.
