DAK-Gesundheit assumes that this procedure does not fall within the scope of cartel procurement law due to the absence of a selection decision and thus the non-discriminatory access opportunity for all pharmaceutical companies. Regardless, it ends automatically with the entry into force of the exclusive contract for the active substance Umeclidinium + Vilanterol, ATC R03AL03, following a formal procurement procedure according to the regulations of Part 4 of the GWB with one or more contracting partners. To accommodate the diversity of potential contracting partners within the approval model, every pharmaceutical company is enabled to conclude a framework agreement at any time and under the same conditions during the contract term. The necessary contract documents are available for download via the online portal www.dtvp.de/center under the link specified in section 5.1.11.
