TENDER DESCRIPTION

DAK-Gesundheit assumes that this procedure does not fall within the scope of cartel procurement law due to the absence of a selection decision and, in turn, the non-discriminatory access possibility for all pharmaceutical companies. It ends, irrespective of this, automatically upon the entry into force of the exclusive contract for the active ingredient glatiramer acetate (exclusively pre-filled syringes), ATC L03AX13, as a result of a formal tender procedure in accordance with the provisions of Part 4 of the GWB with one or more contract partners. To ensure that the diversity of potential contract partners under the approval model is taken into account, each pharmaceutical company is allowed, at any time during the term of the contract, to conclude a framework contract under the same conditions.
