DAK-Gesundheit assumes that this procedure does not fall within the scope of cartel procurement law due to the absence of a selection decision and thus the non-discriminatory access possibility for all pharmaceutical companies. It will end automatically regardless upon entry into force of the exclusivity agreement for the active ingredients Budesonide and Formoterol (exclusively IHP in the strength 80µg/4.5 µg), ATC R03AK07, following a formal procurement procedure according to Part 4 of the GWB regulations with one or more contracting partners. To accommodate the diversity of potential contracting partners within the approval model, every pharmaceutical company is enabled to conclude a framework agreement at any time during the contract term under the same conditions. The required contract documents can be downloaded from the online portal www.dtvp.de/center via the link mentioned under 5.1.11.
